Terms & Conditions - EBUBAY x RedM Art Contest 2025

By participating in this Art Contest hosted by EBUBAY in collaboration with RedM, you agree to the following terms and conditions:

1. Eligibility

1.1.     This Art Contest is open to all individual visual artists who are currently residing in Nigeria and are 18 years of age or older as of the submission deadline.

1.2.     Each submission must be the artist’s original and unaided creation, conceived and executed solely by the entrant. The work must not have been previously:

                a. Exhibited in a public or private forum, whether physical or digital

                b. Sold or offered for sale in any commercial capacity

1.3.     Collaborative artworks or group submissions are not permitted. Each entry must be attributed to a single artist, who shall retain full authorship and responsibility for the work submitted.

1.4.      Artists must be able to demonstrate proof of identity and residency in Nigeria upon request.

 

2. Theme & Format

2.1.     Each submitted artwork must visually interpret and address the theme of human trafficking, which may include but is not limited to its impact, trauma, exploitation, social consequences, or stories of resilience and resistance. Artists are encouraged to explore the theme through any stylistic or conceptual approach, including realism, abstraction, symbolism, expressionism, or conceptual art, provided the underlying message aligns with the contest’s advocacy goals.

2.2.     All submitted artworks must be created or adapted to a final dimension of 16 inches by 20 inches (16" x 20"), whether in portrait or landscape orientation. Any deviation from this format may result in disqualification unless expressly approved in writing by Ebubay.

2.3.     Accepted mediums shall include paintings, mixed media, provided the final file can be printed in line with specifications.

2.4.     All entries must be suitable for public display and must not contain any graphic or offensive content that is inconsistent with the objectives of the contest or that may violate applicable laws or public decency standards.


3. Submission Rules

3.1.     To enter the contest, each artist must first follow EBUBAY’s official Instagram account.

3.2.     Artists must create an original artwork based on the official theme of the contest. This artwork must then be posted publicly on the artist’s own Instagram page, including the hashtag #EbubayArtForSurvivors in the caption. The post must also tag EBUBAY’s official Instagram handle and include a brief description of the artwork in the caption.

3.3.     Once the artist's post is tagged and visible to EBUBAY, the team will review it. If approved, EBUBAY will send a direct message to the artist confirming acceptance into the contest. The artist must then provide the following via direct message or email:

                    a.  A clear digital image of the artwork.

                    b.  The artist’s full name

                    c.  A short artist statement describing the work (maximum 50 words)

3.4.     EBUBAY will post approved submissions on its official Instagram page. Public voting begins as soon as the submission is posted and ends at 11:59 PM (WAT) on August 15, 2025.

3.5.     Artists may submit multiple entries by repeating the steps above. However, only one (1) artwork per artist will be selected and featured as a final entry in the contest.

3.6.     Judging will take into account public engagement metrics including the number of likes on the artwork and followers gained on EBUBAY’s official Instagram page.


4. Selection & Voting Criteria

4.1.     Three (3) winners will be selected based on:

                  a.  60% public engagement determined by the number of likes and new followers received on the artist’s post on the official EBUBAY Instagram contest gallery.

                  b.  40% jury review by EBUBAY’s curatorial panel based on originality, thematic relevance, and execution.

4.2.     Public voting runs immediately the artwork is posted on our Instagram page and ends on August 15, 2025.

4.3.     Winners will be announced on August 18, 2025.

4.4.     All decisions by the jury and EBUBAY team are final.


5. Prizes

5.1.     Cash prizes are awarded as follows:

                   a.  1st place – ₦200,000

                   b.  2nd place – ₦150,000

                   c.  3rd place – ₦100,000

5.2.     Prize money will be paid by bank transfer within 14 business days of the announcement and completing artwork delivery.

5.3.     All winning artworks will be exhibited and auctioned at RedM’s charity event in Houston, Texas, USA.


6. Final Artwork Preparation

6.1.     Winners are solely responsible for:

                  a.  Stretching their artworks to the 16×20 inch format.

                  b.  Delivering the stretched artworks to the designated National Museum location in Nigeria (details provided post-announcement).

6.2.     All deliveries must be completed by the deadline communicated after the winners are announced.

6.3.     Failure to deliver a stretched and finished work on time will result in disqualification and forfeiture of the prize.

7. Ownership & Grant of  Rights

                a.  Upon delivery to the National Museum, physical ownership of the winning artworks transfers to EBUBAY.

                b.  The Artists retain copyright of their image but grant EBUBAY and RedM a worldwide, perpetual, royalty-free, non-exclusive license to reproduce, distribute, and publicly display the artwork for promotion, marketing, exhibition documentation, storing, archiving, and fundraising purposes.

               c.  Artists will not receive proceeds from any sale or auction of the artwork and waive any future claims to such earnings.


8. Artist Warranty and Indemnity

8.1.     By submitting an artwork, the artist warrants that: 

                 a.  He is the creator and sole owner of the rights in the work

                 b.  the work is wholly original and contains no material that infringes the copyrights or any other intellectual property right, any other right of any person. 

                 c.  Not to, at any time enter into any agreement which conflicts in any way with this Agreement or undertake or permit activities which will interfere with, diminish, compete with the exercise of any of the Rights in the herein granted.

8.2.     The Artist indemnifies EBUBAY and RedM from any claims of copyright infringement, moral rights violation, or any legal challenge arising from their submission.

8.3.     The Artist undertakes to indemnify EBUBAY and RedM against all liabilities, claims, demands, actions, costs, damages or loss arising out of any breach of its obligations and warranties under this Agreement.

 

9. Transportation Risk & Liability

9.1.     Artists who emerge as winners are responsible for the safe delivery of stretched works to the designated location in Nigeria.

9.2.     Ebubay will manage international shipping and export documentation from the National Museum to Houston in accordance with applicable laws and regulations. Artists may be required to provide additional documentation (e.g., proof of identity, certificate of authenticity) to facilitate customs clearance.

 

10. Dispute Resolution

10.1.     These Terms & Conditions shall be governed by and construed in accordance with the laws of the Federal Republic of Nigeria. 

10.2.     Any disputes arising out of or in connection with this contest shall be resolved through an amicable settlement. But if the Parties fail to settle the dispute amicably within ten (10) days of holding consultations, such dispute shall be settled by final and binding arbitration, in accordance with the MSME Arbitration Scheme Rules of the Chartered Institute of Arbitrators UK, Nigeria Branch, by a sole arbitrator appointed by the Chairman of the Chartered Institute of Arbitrators UK, Nigeria Branch. 

10.3.     The Arbitration shall be in English language and shall be held in Lagos, Nigeria

10.4.     The cost of the Arbitration shall be borne by the Parties.   


11 General Terms

11.1.     By submitting an entry, participants consent to the collection and use of their personal data (name, contact information, artist statement) for the purposes of contest administration, communication, and promotion. EBUBAY will not share personal data with third parties except as required for contest execution or legal compliance. Data will be stored securely and may be retained for future opportunities unless the artist requests deletion.

11.2.     EBUBAY reserves the right to disqualify any entrant found to have manipulated voting metrics or submitted plagiarized work.

11.3.     EBUBAY is not liable for artwork damage or delays during transport from the artist to the museum.

11.4.     By entering, Artist agrees to be contacted by EBUBAY for contest updates, exhibitions, or future art opportunities.

11.5.     In participating in this contest, Artists agree to be bound by these terms and conditions.
